1. Who These Terms Cover
These terms apply when you use the advertising setup and management services of Albarosa ApS ("Albarosa", "we"), offered under the trade name Albarosa Ads. Albarosa ApS, CVR 46542193, Sønderborg, Denmark. Contact: hello@albarosa.net · +45 52 51 34 63.
2. What We Do — and Don't Do
We plan, build and manage paid advertising campaigns on your behalf on Google Ads, Google Local Services Ads, and Meta (Facebook and Instagram). We do not own or operate these platforms. Ads are served by the platforms under their own policies and review processes. Where these terms say "we run your ads", it means "we set up and manage campaigns in ad accounts you own, on your behalf".
3. Quotes and Pricing
- Setup and management are quoted in writing before any work starts. The quote states exactly what is included and whether the fee is one-off or monthly.
- Ad spend is paid by you directly to the advertising platforms, using a payment method on your own ad account, unless we agree otherwise in writing. We add no margin to ad spend and take no percentage of it.
- Quotes are valid for 14 days unless stated otherwise, because scope and platform requirements change.
- Work beyond the agreed scope (extra revision rounds, new campaigns, new platforms, rush launches) is quoted separately before it happens. No surprise invoices.
4. Ad Creative, Previews and Approval
- You receive the ads, targeting and budget for review before anything goes live. Two rounds of changes are included in the quoted price.
- Your approval is required before any ad is published or any budget is spent. Once you approve, we publish exactly what you approved.
- If you supply logos, images, videos or text yourself, you confirm you own the rights to use them. We're not liable for ad content or claims you insist on keeping despite our advice — including typos you approved in writing.
5. Advertising Platforms and Results
- We launch campaigns after your written approval of both the ads and the budget.
- Platforms set their own review times, policies and verification checks, and may reject, limit or pause ads. We give realistic estimates but cannot guarantee a third party's decisions or timeline.
- If a platform wrongly rejects an ad or restricts your account, we handle the appeal with them so you don't have to. For Local Services Ads, we dispute leads that qualify as invalid under Google's rules.
- Advertising results depend on your market, pricing, reviews and how quickly leads are answered. We do not guarantee any particular number of leads, calls, clicks or sales.
- Business details you give us (licences, insurance, address, service area) must be accurate. Delays or account restrictions caused by inaccurate information you gave us are at your cost.
6. Account and Creative Ownership
Your ad accounts are set up in your name and belong to you from the start. Once our invoice for the work is paid, you also own the ad copy, images, videos and audiences we created for you. You may take them to any agency, forever. Before payment, creative remains ours.
7. Claims
Review your campaign reports and platform billing promptly and report any setup error within 7 days of noticing it, ideally with screenshots. Errors caused by us against what you approved (wrong budget, wrong targeting, wrong ad) are corrected at no cost to you. Results you approved but are unhappy with are not setup errors.
8. Cancellation
- Cancel before setup work begins: full refund of any deposit.
- Cancel after setup work has begun: hours spent are invoiced at the quoted rate.
- Cancel once campaigns are live: management ends at the close of the current billing month, and we pause the campaigns or hand them over to you. Ad spend already charged by the platforms is between you and the platform.
9. Liability
We are liable only for direct losses up to the amount you paid us for the work in question, except where Danish mandatory law says otherwise. We are not liable for indirect losses such as lost profit or lost business arising from platform decisions, delayed approvals, or campaign performance.
10. Governing Law
Danish law applies. Disputes are settled by the courts of Denmark.
11. SMS Messaging Terms
This section governs text messages (SMS) you may receive from Albarosa Ads. It works together with our Privacy Policy, which explains how phone numbers are stored and protected.
- Program description: When you ask us to communicate by text — whether by email, phone, or chat — we send you messages relating specifically to your enquiry or ad campaign — quotes, ad approvals, campaign updates and account verification requests. We do not run promotional SMS blasts under this consent.
- Message frequency: typically 2–6 messages per month. There is no recurring subscription and no scheduled SMS marketing.
- Who we text, and from what number: Clients in the United States are messaged from a US long code registered for business messaging (A2P 10DLC) under Albarosa ApS. Clients in Denmark and the rest of Europe are messaged from our Danish number. We use a US number for US clients because a foreign number is expensive to reply to, is widely filtered by US carriers, and looks like a scam — none of which helps you get your ads approved.
- Sending hours: We send only between 8am and 9pm in the recipient's own local time zone, regardless of the time in Denmark. Albarosa operates nine hours ahead of California, so messages composed at the end of our working day are queued and delivered during yours.
- Cost: Message and data rates may apply, depending on your mobile carrier and plan.
- Opting out: Reply STOP to any message from us. You will receive no further texts from Albarosa Ads, effective immediately, and your number will be suppressed. Opting out does not affect your campaign — we'll simply switch to email or phone.
- Help: Reply HELP to any message and you'll get our contact details back automatically. You can also email hello@albarosa.net at any time, or call +45 52 51 34 63 during Danish office hours. Email is the fastest route from the US — it's answered by the following morning your time.
- No sharing: Your mobile number and consent information are never sold or shared with third parties for their own marketing purposes. Carriers and our messaging platform (LeadConnector / GoHighLevel) process messages solely to deliver them.
- Carrier disclaimer: Carriers and message delivery platforms are not liable for delayed or undelivered messages. If a text doesn't arrive, call or email us — nothing about your campaign depends on a single text being seen.
